APUSH, Period 5 Louis D. Brandeis Louis D. Brandeis was a lawyer widely known for his contribution to the progressive movement especially his involvement in the fight against big corporations, monopolies, big trusts etc. Brandies was born into a Jewish family to who resided in Louisville Kentucky. They raised him with relaxed Judaic principles, which did not affect his outlook on life too strongly. Brandeis enrolled to Harvard Law School graduating with the highest final average in the school’s history. His law career began in Boston as a law clerk to Horace Gray of the Massachusetts Supreme Court.To which he did not have to take an examination mainly due to his high honors. President Woodrow Wilson ultimately appointed Brandeis an associate of justice. Louis D. Brandeis was known as the people’s lawyer because of his successful law career that supported the general idea of the average American. Brandeis’ law career was mostly based on his positive view towards t he progressive era/ movement; he was a strong advocate on natural rights and freedom of speech, Brandeis supported the union movement, women’s rights, and the fight for a minimum wage.Brandeis was in favor of small business and set out to bust the big companies from being monopolies. One of his biggest busts against monopolies was the fight against JP Morgan and his desire for a railroad monopoly in New England. His plan was to eliminate the opposing companies by buying them out. Brandeis would pursue this case for 6 years and the company would ultimately collapse on itself as he predicted. Brandeis did not agree with how life insurance was being treated so he set out to create a new plan for it. He said that the previous insurance plan was just â€Å"legalized robbery†.He created the Savings Bank Life Insurance policy, which we can thank him for even today. This is insurance provided by savings banks presumably making it better for the applicant. He said â€Å"cheape r insurance may rob death of half of its terrors for the worthy poor†. Brandeis was in support of the idea of minimum wage on a national level rather than a state level. He believed that the worker should be guaranteed a minimum pay and hours just like the unions wanted. The case Muller v. Oregon involved the issue of state v. ederal law in regards to the issue of minimum wage and hours of women. Brandeis fought for the idea of it being on a national level to ensure that all workers were treated equally. He succeeded by presenting his idea with a shorter more traditional brief, but with large factual support in documents such as social worker reports, medical conclusions, factory inspector observations, and other expert testimonials to prove his ultimate point that a certain amount of time was harmful for the given worker and that if this were a possibility a higher wage must be presnted.This tactic is called the Brandeis Brief and it is still used in court cases today; it com pletely changed the way lawyers display their edvidence. Brandeis was a big leader in supporting the progressive era and the reforms that went along with it. On staff rota there are only four different shifts firstly from 06:00 -15:00, secondly from 08:00 – 17:00, thirdly from 14:00 – 23:00 and lastly from 23:00 08:00. Staff rota helps them a lot to see who in and who off. They are using excel to do the staff rota, on a first column they put the staff names and followed by how many days offs did the company give you, on first raw they put the number of guests in-house followed by the dates and days, at the end there’s a column of days off being owed to staff or days being owed to the company by staff. They save staff rota in computers to keep their records or for later changes. Staff is allowed to request certain days offs if they do have some appointments but it will depend how busy it will be that day. When staff rota is done it will be taken to the relevant department and put them on notice board so that everyone can see it. The compassionate leave applies when the employee has to deal with emergency involving someone who depends on him/her e.g. child, husband or wife. Sick leave – They are entitled 12 days off sick in a year, if the employee exceeds then they will subtract the days from annual leave and give them full pay. If it may happen that they have taken the entire annual leave they then notify the employee to take an unpaid leave and they won’t pay any salary to the employee. Time off – they are entitled to off 6 days a month of which they work five and half days and get off. They will be paid full salary. Worker’s Compensation – If an employee gets injury at work the company will pay hospital bills and pay the employee the employee full salary during those days not at work. What is position do Black American hold in society today? If Black Americans were to just disappear without a trace, would it effect America economically, politically, and socially? The answer is yes, but we would not have the power to survive on our own. The only power that we truly have is buying power in America. Black Americans are infamous for putting their money into things that are materialistic rather than things that will turn their money over. Things that will build up the community such as black owned establishments. Despite the economic set backs we place ourselves in, politically we have no strong voices and our social leaders do not seem to understand how to elevate the problems that continue to plaque our society. Who can we turn to? I am convinced that if we trace back to learn theories of past African America leaders on these issues then we can eventually come to new heights. This paper will identify the primary economic, political, and social needs of African Ameri cans at the turn of the century and determine if the philosophies of Booker T. Magnuson-Moss Warranty Act= Requires any supplier that offers a written warranty on a consumer product costing more than $15 to disclose the terms of the warranty in simple and readily understandable language before sale. *Magnuson-Moss Warranty Act does not require manufacturers or sellers to provide a warranty on their products. Consumer product safety Commission= Evaluates consumer products and develops safety standards. Consumer Product Safety Act (CPSA)= the goal is to prevent injuries from products. Consumer Leasing Act (CLA)= protects a person when leasing a car. Makes sure that the company discloses all important information in writing, so that the borrower knows what the payments, interest, penalties, rights, and warranties are. Debit Card= This item works like a check because money is taken directly from your account so their is no bill. Rules of a Debit Card: If you report it stolen before any purchases are made, you are not responsible for any amount. If you report it stolen with in two days, you are responsible for $50. If you report it stolen after two days, you are responsible for $500. Chapter Conclusion Virtually no one will go through life without reading an advertisement, ordering from a catalog, borrowing money, needing a credit report, or using a consumer product. In the case of a high-rate home equity loan, the lender must notify the consumer at least three business days before the closing that (1) he does not have to go through with the loan (even if he has signed the loan agreement) and (2) he could lose his house if he fails to make payments. Under TILA, consumers have the right to rescind a mortgage (other than a first mortgage) for three business days after the signing. If the lender does not comply with the disclosure provisions of TILA, the consumer may rescind for up to three years from the date of the mortgage. 10. Under TILA, a credit card holder is liable only for the first $50 in unauthorized charges made before the credit card company is notified that the card was stolen. If, however, you wait more than two days to report the loss of a debit card, your bank will only reimburse you for losses in excess of $500. If you fail to report the lost debit card within 60 days of receipt of your bank statement, the bank is not liable at all. 11. usChristina Bramanti October 5, 2012 CLAS 20105 The Role of Oracles, and Dreams in Herodotus’ The History Throughout Herodotus’ The History, Oracles, and dreams play an important role. While the gods have almost no presence throughout the book, the Oracles and/or dreams are linked to many of the major events. We first encounter the Oracles in Book I, when Croesus asks the Oracles at Delphi if he should attack the Persians, the Oracle replies telling him (in a very ambiguous way) that if he fights, he will destroy a great empire (7. 12).Unbeknownst to Croesus, the empire he will destroy will be his own. However, this answer from the Oracle is one of the things that convinces Croesus to attack Persia, in a manner jumpstarting the war. It could be that Croesus was always fated to destroy his empire, for the Pythia said, â€Å"Fate that is decreed, no one can escape, not even a god. Croesus has paid for the offense of his ancestor† (1. 91). This was important to reme mber throughout the book. Whether Herodotus believed it or not, the Oracles and Magi believed that one could neither change nor escape fate.In Book VII, the Oracles tell the Athenians that a wall of wood and Salamis will save Athens. When the Athenians first consulted the Pythia at Delphi, whose name was Aristonice, their demise was foretold. They asked for a different oracle. â€Å"My Lord,† they asked, â€Å"give us a better oracle about our fatherland; be moved to pity the suppliant boughs with which we come before you, or we will never go away from your shrine but remain right here till we die† (7. 141). The priestess replied: No: Athena cannot appease great Zeus of Olympus With many eloquent words and all her cunning counsel.To you I declare again this word, and make it as iron: All shall be taken by foemen, whatever within his border Cecrops contains, and whatever the glades of sacred Cithaeron. Yet to Tritogeneia hall Zeus, loud-voiced, give a present, A wall of wood, which alone shall abide unsacked by the foemen; Well shall it serve yourselves and your children in days that shall be. Do not abide the charge of horse and foot that come on you, A mighty host from the landward side, but withdraw before it. Turn your back in retreat; on another day you shall face them.Salamis, isle divine, you shall slay many children of women, Either when seed is sown or again when the harvest is gathered. (Herodotus, 1. 141) The Athenians argued about what this meant, whether they will be victorious or defeated at Salamis. Themistocles concluded that, if the oracle referred to Salamis as â€Å"isle divine† that must mean that the Greeks would be victorious, because, he argued, it would have been referred to as â€Å"O Cruel Salamis† if all of its inhabitants were going to die. He then convinced the men to prepare for a sea battle. The ‘wall of wood’ would be their ships.The Athenians agreed with Themistocles, if, for no other rea son, than his explanation sounded better than that offered by the oracle-interpreters. Hope, they saw, was better than despair. In this instance, the Oracles do offer some idea of what will come, but the oracle-interpreters, whose purpose is to interpret, are essentially ignored. Themistocles heard what was said and picked out a phrase by which he explained the rest of the prophecy. The Athenians believed what they wanted to believe, which was that Salamis would be a Greek victory, and the ships made up the wall of wood to which the Oracle referred.While the Athenians do not listen to what the oracle-interpreters had to say, they did take to heart what was told to them by the Oracle, and this led to many of the Greek peoples uniting—Argos sided with Persia; Gelon of Syracuse refused to help unless he could lead, thereby offending the Spartans; Corcyra assembled men and ships and went to the war, but sat on the sidelines watching; and Crete refused to join. The united Greece, led by Leonidas, decided to fight at Thermopylae, where Leonidas was killed. However, after this, the war goes to Salamis, where the Greeks, surrounded, battle the Persians, forcing Xerxes to retreat with his army.Dreams also play a particular role in Herodotus’ The History. Like the Oracles, dreams influence people to make certain decisions. And like the situations with the Oracles, fate also plays a role. These people had these specific dreams because they were fated to make said decisions. The dreams, possibly, were the only ways to convince them, or to ensure that fate run its course. So was the case with Astyages, who dreamt of his daughter, Mandane, â€Å"making water so greatly that she filled all his city and flooded†¦all of Asia† (1. 107). Astyages immediately went to visit the Magi who were dream interpreters.Fearing that this meant she would have more powerful offspring, he married her, not to a Mede, but to a lesser, Persian man. However, fate would no t back down. After his daughter was married to the Persian, Astyages had another dream. â€Å"†¦It seemed to him that out of his daughter’s privy parts there grew a vine, and the vine shaded all Asia† (1. 108). Astyages again went to dream interpreters among the Magi, who suggested that this dream meant that Mandane – who was now, in fact, pregnant – would have a child who would become king in the place of Astyages. This is the point in the story where fate really comes into play.Much like the story of Oedipus, attempting to control or otherwise act in a way opposed to, fate seems to be exactly what allows for fate to run its course. Astyages takes the child, a son, when it is born and hands him over to a kinsman, Harpagus, and orders Harpagus to kill the child. Harpagus agrees, but cannot bring himself to do such a thing. Harpagus, in turn, hands the child over to Mitradates, a slave herdsmen of Astyages. Harpagus also passes on the task of murderin g the child. When Mitradates gets home with the child, he tells his wife, Cyno, the task with which he had been charged.Cyno, however, had given birth that day to a child who was stillborn, and she suggested that they place the dead child on the mountain to ‘die’ and raise Mandane’s child as their own. This way, they still get to raise a child, and the innocent boy is not killed. By removing the child from his mother, and handing him over to his death, Astyages is creating the path for which the foreseen future can now happen. One day, the boy was playing with children in town and they named him their king, and he reprimanded one of the children, a son of a man of higher rank than his herdsman father.They were all brought before Astyages, and this is how he came to learn that the boy had not been killed. When the Astyages learned that the boy, who would be called Cyrus, but was not yet at this time called Cyrus, was still alive, at first he was angry with Harpagu s, and he killed Harpagus’ son and fed his flesh to Harpagus. Then, after consulting with the Magi, he believed that the dream had already come true, since the boy was named king. â€Å"As it is,† the Magi told him, â€Å"the dream has issued in something trifling; we are ourselves quite confident and bid you be the same.So send the boy away from your sight to the Persians and his parents† (1. 120). When Astyages sent the boy away to live with his true parents, Harpagus watched him grow into a man, and when Cyrus was a young man, Harpagus sent him a message, suggesting that he overthrow Astyages, for he [Astyages] had ordered Cyrus’ death. Had it not been for himself and the gods, Harpagus argued, Cyrus would have been murdered when he was an infant. In this way, the dream explained by the Magi came to be fulfilled. In Book VII, Xerxes dreams of a man coming to him and reprimanding him for his indecision. Are you changing your mind, Persian, and will not lead your army against Greece after you have bidden the Persians to gather their host? † the man asks Xerxes. â€Å"You will not do well, so to alter your counsel, now will he who stands before you prove forgiving. As you have resolved by day to do, that is the road for you to tread† (1. 153). Thomas Harrison, in his book, Divinity and History: The Religion of Herodotus, argues that misinterpretation of the Oracles was the rule, rather than the exception. Harrison essentially discredits the oracles because they are so ambiguous. Not only do such instances of mistaken interpretation reinforce†¦the fated nature of the eventual outcome, but at the same time they supply their audience with the tools to explain apparent non-fulfillment: the story of Croesus serves to illustrate both the possibility of fulfillment against one’s expectations and†¦that of dormant oracles, long forgotten, being fulfilled nonetheless. † To a point, this makes sense. The Ora cles are constantly, it seems almost intentionally, ambiguous, and the message is almost always misinterpreted, often times to the listener’s detriment.The Oracles and dreams play a crucial role in Herodotus’ The History. The book is driven mostly by reactions to things either heard from an Oracle, or experienced in a dream. Sometimes trying—unsuccessfully—to change what was foretold, and sometimes trying cause what is believed to be the meaning. Fate, however, has run its course. No matter how many times someone tried to change what was prophesied, whatever they did to change it just ended up being the cause of that which was trying to be avoided.

Competitive Sport an activity involving physical exertion and skill in which an individual or team competes against another or others for entertainment and victory. As the report of the World Sports Encyclopedia (2003) indicated that there are around 8000 kinds of sport in the whole world. By this, football, basketball, baseball, and volleyball are good examples for expressing more understanding on competitive sport. In each sports, even though leading to play not only by different ways or structures but also by different rules, its purpose of teaching about life to people is similar to one another. Moreover, all of the results from sport can influence people in many ways such as physical, mental and emotional. However, exactly all these results contain its own not only advantage but disadvantage as well. Learning to work as team, Learning to handle with the failure, and †¦Ã¢â‚¬ ¦.. is the main point that people should be consider on carefully. As the same thing, some noticeable disadvantages which strongly against with competitive sport are getting injury, wasting too much time, and gambling illegally. In sport, teamwork is an important part that requires collaborative effort on the part of a group of people who acting as a team to achieve the same goal, and emerge as a champion. As a team, teamwork isn’t an easy thing that you can do it alone. Obstacles as conflict among the teammates or unequal can affect the team’s performance. Teammates need to connect with each other well to give a good performance. As the observation from 40 university students of Dr. Nick Holt, a professor of Faculty of Physical Education and Recreation at the University of Alberta, showed that we can target three life skills such as confidence, leadership, and teamwork from sport. Moreover, teamwork itself reinforced the idea that sport can provide an educational context for acquiring life skills and highlighted interactions with key social agents are crucial components of how people learn life skills through their involvement in sport. In group, however, sometimes there will have one person who acts individuals to create a good performance alone while other may be passively committed. If it has to be a real competition, the person who is passively committed can make a group not in a high level of competition, also in the circumstance that the group in running behind of the score can cause the team lose the opportunity to win the game. Under the situation like these, people who are actively committed  might try to think the best strategy to compete with the opposite team while those who are passively committed may be giving up already. So, to give a good performance during the competition, teamwork is really important and people who can lead the ream well would be learnt that the success of the individual isn’t important as that of the team. Teamwork can teach them humility and selflessness, also will teach them to work with each other well if want to achieve a common goal. Sports are often used as a metaph or for life. It means that in sport you have to train and work hard to success, so do for life. In short, if you want to achieve something, you have to work your butt-off to get that thing just like you want to win the competition in sport. The harder you work the more you will be rewarded. Competitive sports teach us how to get success in life by using your failure. As we can see in competitive sports, there are winners and losers. In some case, you win the games; you celebrate well-deserved wins with your teammates happily. However, in some cases you lose; you might get upset and frustrated or sometime you happen to dread every competition and you start to fear your opponent as well. Basically, Failure is absolutely necessary for success. It’s like that hot and cold type of thing; one would never know exactly what hot is without cold. So the first thing you should do is to accept the gift of failure with a positive way because those failures are a reality of life and it can be your experience to help you grow more powerful. The more experience you get, the more you want to challenge with your opponent. Most successful people will tell you, the moments that affected them the most, the ones that they will never f orgot, were the ones where they failed because in those moments you realize exactly what you are made of. According to National Basketball Association, Micheal Jorden, a greatest basketball player, is a successful player who never let his failure stop him from playing the game he likes the most. The reason why he becomes a successful player is that he always embraces setbacks and failures as fuel and motivation. In high school, he was cut from the team as sophomore but he didn’t get upset or frustrated at all, yet he used that as fuel and trained intensely. He became a popular player in his team as the result. The quote he made is â€Å"I’ve missed more than 9000 shots in my career. I’ve lost almost 300 games. 26 times, I’ve been trusted to take the game winning shot and missed. I’ve failed over and over and over again in my life. And that is why  I succeed.† The same is true in life; we’ll need to use these failures to help you refocus your energy on how to win those competitions next time. Although having taught many considerable lesso ns to one’s life, sport has several disadvantages influencing one’s life as well. In this case, there is a question that â€Å"why don’t adult people like their kids to play football?†. First of all, Physical Injury is the main problem they have realized so far. According to the statistic from the National SAFE KIDS Campaign and the American Academy of Pediatrics in the United State of America indicated that there are about 30 million children and teenagers participate in any sports, and more than 3.5 million of them injuries each year. By far, the most common injuries are sprains and strains. Moreover most of the injuries occurred as a result of falls, being struck by an object, collisions, and overexertion during unorganized or informal sports activities. Unfortunately, if the injury was serious, it can be influenced to one’s future because of this physical injury. For example, one of my friends likes to play football so much, but one day he got an accident with his leg. After having checked on his leg for two months, the doctor said that that leg couldn’t cure forever and my friend cannot do any activities with his leg anymore even walking. Secondly, wasting too much time with sport is the noticeable point to consider as well. By football, it will keep the kids from other activities such as social gatherings, communication activities and many others. Furthermore, for students, it will keep them away from learning activities such as reading book, doing homework, and researching. Finally, illegal gambling in sport is also the one of serious concerns such as gambling in football. During the FIFA WORLD CUP fever, we saw many illegal gambling in football has increased rapidly in Cambodia. As reported by The Cambodia Daily Newspaper published on June, 18th 2014 showed that many illegal World Cup betting centers are took place at the crowded cafà © and give out the betting slip. For this result, many teenagers can know how to bet the football match well, so they will try it because of money. Instead, if they lose the gambling, they will find more money to try it again and again that why it can cause many crimes because of their illegal activities. Depending on the Newspaper above added that many kinds of crimes have increased since there has been the betting on FIFA World Cup 2014. Moreover, not only do the losers commit the crime in the society but they  also steal their parents’ money or selling something such motor, laptop and mobile phone for betting the match again. In short, sport have also taught several negative effects to one’s life foll owing by getting injury, wasting time, and gambling illegally. In conclusion, Competitive Sport provides us many useful lessons of life though its own advantage and disadvantage. Instead, to avoid disadvantage of that, before performing that sport, you have to realize deeply and carefully that it will cause the problem for you or not. Although competitive sport has amount of disadvantage which we need to consider, I strongly convince that competitive sport should be performed by every people, especially for the kids and teenagers, because of its most valuable advantage. To support this, I can say that if you yourself play competitive sport, you will taste the way to be a valuable person through learning the necessary advantage of connection between life and sport. So that, there is a quote which say that â€Å"The more sport you play, the more lesson you get†.
